Please read these Terms of Service ("Terms") carefully before using EekPub (the "Service"). By uploading a file or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

EekPub is a free, browser-based tool that accepts EPUB files uploaded by users, analyzes them for common structural and formatting issues, and offers automated fixes. The Service is provided on an "as is" and "as available" basis.

EekPub is not an e-book store, publishing platform, or DRM-removal tool. It processes files only for the purpose of identifying and repairing technical issues.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have obtained your parent or guardian's permission.

3. Your Content and Intellectual Property

You retain all ownership rights to any EPUB files you upload ("Your Content"). By uploading a file, you grant EekPub a limited, temporary, non-exclusive license to process that file solely for the purpose of providing the Service to you.

You represent and warrant that:

• You own the EPUB file you are uploading or have the right to upload and process it.
• Your Content does not infringe any third party's intellectual property rights, privacy rights, or any applicable law.
• Your Content does not contain malware, exploits, or any content designed to damage or disrupt computer systems.

We do not claim any ownership over Your Content.

4. File Handling and Data Retention

Uploaded files are stored temporarily in server memory and on disk solely to perform the requested analysis and repairs. All uploaded files are automatically deleted within one hour of upload, and often sooner. We do not back up, index, read, or use Your Content for any purpose other than providing the Service.

We strongly advise that you keep your own copy of any file you upload. We are not responsible for any data loss during processing.

5. Acceptable Use

You agree not to use the Service to:

• Upload files that contain viruses, malicious code, or exploits.
• Circumvent DRM (digital rights management) protection on content you do not own.
• Attempt to overload, scrape, or reverse-engineer the Service.
• Upload files containing illegal content, including but not limited to content that infringes copyright, defames individuals, or is obscene.
• Use the Service in any way that violates applicable laws or regulations.

We reserve the right to block access to the Service for any user we reasonably believe is violating these Terms.

6. File Size and Rate Limits

Individual file uploads are limited to 50 MB. We may impose rate limits or usage restrictions at any time to maintain service quality for all users, without notice.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or available at any particular time.
• Every EPUB issue will be detected or successfully repaired.
• The repaired EPUB will be accepted by any particular reader, storefront, or distributor.
• The Service is free from security vulnerabilities.

Always test repaired files thoroughly before distribution.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EPUBFIXER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $10 USD OR THE AMOUNTS YOU HAVE PAID TO US IN THE PRECEDING TWELVE MONTHS (WHICH FOR A FREE SERVICE IS $0).

9. Third-Party Services

The Service uses Google AdSense to display advertisements. Google may collect data in connection with ad delivery as described in Google's own privacy and cookie policies. We are not responsible for Google's data practices. You may opt out of personalized advertising at any time using the cookie preference control on this site.

The Service uses Google Fonts. Font files are served from Google's CDN; Google may log your IP address as part of that request.

10. Changes to the Service and These Terms

We may modify or discontinue the Service, or update these Terms, at any time without notice. Continued use of the Service after any change constitutes your acceptance of the revised Terms. We will update the "effective date" at the top of this page when material changes are made.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service operator is located, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
